Welcome to Qatar Web Developers ("we," "our," "us"). These Terms and Conditions ("Terms") govern your use of our website (https://qatarwebdeveloper.com) and the services we provide, including web design, web development, SEO, e-commerce development, and related digital services.

By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Definitions

• "Client" — The person or business entity engaging our services.
• "Services" — Web design, web development, SEO, e-commerce development, website maintenance, hosting, and related digital services.
• "Project" — A specific scope of work agreed upon between us and the Client.
• "Deliverables" — The final work product provided to the Client (website files, code, designs, etc.).
• "Quote" — A fixed-price estimate provided for a specific Project.

2. Acceptance of Terms

By using our website or engaging our Services, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using our Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Our Services

We provide web design, web development, SEO, e-commerce design, website maintenance, hosting, and related digital services to businesses in Qatar and worldwide. Each Project is governed by a specific Quote or Statement of Work agreed upon in writing (via email, WhatsApp, or formal contract).

We reserve the right to refuse service to anyone for any reason at any time.

4. Quotes, Pricing, and Payment

4.1 Quotes

All Quotes are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the scope of work described. Any additional work outside the scope will be quoted separately.

4.2 Pricing

All prices are in Qatari Riyals (QAR) unless otherwise specified. Prices do not include third-party costs such as domain registration, hosting fees, premium plugins, stock photos, or payment gateway fees unless explicitly stated in the Quote.

4.3 Payment Terms

• One-time Projects (web design, development, e-commerce): 50% advance payment to begin work. Remaining 50% due upon completion and before final delivery/live launch.
• Ongoing Services (SEO, maintenance, hosting): Monthly payments in advance. First payment due before services begin.
• Custom/Enterprise Projects: Milestone payments as agreed in the Quote.

4.4 Late Payments

If payment is not received within 15 days of the due date, we reserve the right to pause work on the Project. For ongoing services, late payments may result in service suspension. A 10% late fee may apply to overdue invoices.

4.5 Refund Policy

Due to the digital nature of our services, advance payments for one-time Projects are non-refundable once work has commenced. However, we guarantee our work quality. If you are unsatisfied with deliverables, we will make reasonable revisions at no additional cost. For ongoing services, unused months can be canceled with 30 days' notice, and no further payments will be charged.

5. Project Timeline and Delivery

Estimated timelines provided in Quotes are good-faith estimates. Actual delivery may vary based on Client responsiveness, complexity of requirements, and unforeseen technical challenges. We will communicate any delays promptly.

The Client agrees to provide necessary content (text, images, logos, branding guidelines) within 7 days of request. Delays in Client-provided content may extend the timeline.

6. Client Responsibilities

The Client agrees to:

• Provide accurate, complete information about the Project.
• Provide content (text, images, branding) in a timely manner.
• Review work-in-progress and provide feedback within reasonable time (typically 3-5 business days).
• Obtain necessary licenses for any third-party assets (images, fonts, plugins) provided to us.
• Ensure they have the right to use any content they provide.

7. Intellectual Property Rights

7.1 What You Own

Upon full payment for the Project, the Client owns the final deliverables (website files, custom code, design assets) created specifically for them. We transfer ownership to you.

7.2 What We Own

We retain ownership of our pre-existing tools, code libraries, frameworks, and templates that are not specifically created for your Project. We grant you a perpetual, royalty-free license to use these components as part of your website.

7.3 Third-Party Assets

Any third-party assets (premium themes, plugins, stock photos) used in your Project are subject to their respective licenses. We will inform you of any ongoing license fees.

7.4 Portfolio Rights

We reserve the right to display completed work in our portfolio, social media, and marketing materials unless the Client requests otherwise in writing.

8. Website Hosting and Maintenance

If you purchase hosting or maintenance services from us:

• We provide hosting on third-party servers (DigitalOcean, AWS, etc.). We manage the server but are not responsible for third-party outages.
• We perform regular backups and security updates. However, no system is 100% secure.
• For maintenance plans, we respond to support requests within 2 business days.
• Hosting and maintenance can be canceled with 30 days' notice.

9. SEO Services Disclaimer

We provide SEO services using industry-standard white-hat techniques. However:

• We cannot guarantee specific rankings, positions on Google, or traffic numbers. Google's algorithm changes frequently.
• Results vary based on competition, industry, website age, and other factors.
• We guarantee that we will use ethical, sustainable methods. No black hat techniques.
• SEO is a long-term strategy. We recommend a minimum commitment of 3-6 months to see meaningful results.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages arising from our services or website use.
• Our total liability for any claim related to our services is limited to the amount paid by the Client for the specific service in the 6 months preceding the claim.
• We are not responsible for any loss of revenue, profits, data, or business opportunities.

11. No Warranty

Our services are provided "as is" and "as available." We do not warrant that:

• The services will be uninterrupted, error-free, or secure.
• The results obtained from our services will meet your specific requirements.
• Any errors will be corrected within a specific timeframe.

We strive for excellence but cannot guarantee perfection.

12. Indemnification

The Client agrees to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

• The Client's use of our services or website.
• The Client's violation of these Terms.
• The Client's violation of any third-party rights (including intellectual property).
• Any content provided by the Client that infringes on copyright or other rights.

13. Termination

Either party may terminate ongoing services (SEO, maintenance, hosting) with 30 days' written notice.

We may terminate or suspend access to our services immediately, without notice, for conduct that violates these Terms or is harmful to other users or us.

Upon termination, the Client must pay any outstanding amounts for work already completed.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Qatar.

Any dispute arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Doha, Qatar, in accordance with the Qatar International Court and Dispute Resolution Centre rules.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. For significant changes, we may notify you via email or WhatsApp. Continued use of our services after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with any Quote or Statement of Work, constitute the entire agreement between the Client and us regarding our services. They supersede any prior agreements, communications, or proposals, whether oral or written.
